1. Agreement and scope
These Terms of Use (“Terms”) apply to the Canyon Rush: Moto Racing iOS application (the “App”), the website at canyonrush.net (the “Site”), and related support services. Canyon Rush is published by Maksim Arsic (“we,” “us,” or “our”). By downloading, accessing, or using the App or Site, you agree to these Terms and, for the App, Apple’s Standard EULA. If you do not agree, do not use the App or Site.
2. Eligibility
You may use the App and Site only if you can legally agree to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian should review and agree to these Terms for you.
3. Permitted use and conduct
You may use the App for personal, non-commercial entertainment in accordance with Apple’s Usage Rules, the Standard EULA, and applicable law. You must not:
- use cheats, automation, exploits, modified clients, or other methods intended to falsify scores or gain an unfair leaderboard advantage;
- interfere with the App, Site, Game Center, advertising, purchases, security, or other users’ experience;
- attempt to access non-public systems, data, source code, or services except where applicable law expressly permits it;
- copy, sell, redistribute, sublicense, or commercially exploit the App, Site, artwork, or other content without written permission;
- use the App or Site for unlawful, abusive, fraudulent, or harmful activity.
Canyon Rush is a fictional game. It is not real-world riding instruction, and gameplay should not be imitated on public roads.
4. Gameplay, scores, and Game Center
The App may submit best times and related information to Apple Game Center. Your Game Center display name and score may be visible to other Game Center users according to Apple’s settings and policies. Leaderboards and scores may be delayed, unavailable, reset, corrected, or removed due to technical issues, suspected manipulation, service changes, or enforcement by Apple or us. We do not guarantee that any score or ranking will remain available permanently.
5. Advertising and external services
The App may display interstitial advertisements provided through Google AdMob. Ad availability, content, and frequency can vary by device, region, network conditions, consent status, and advertising inventory. The App also relies on external services including Apple Game Center, Apple StoreKit, Google AdMob, and Cloudflare. Those services are governed by their own terms and policies and may change or become unavailable.
Third-party advertisements and links do not constitute our endorsement. Use of third-party content or services is at your own discretion and may be subject to separate terms.
6. In-app purchases
The App offers a one-time, non-consumable “Remove Ads” purchase. Purchases are offered, processed, billed, and restored by Apple through the App Store. Prices and availability may vary by country or region. We do not receive your full payment-card information.
When Apple confirms the entitlement, Remove Ads disables interstitial advertisements within Canyon Rush. Use the Restore button in the App while signed into the Apple Account that completed the purchase to request restoration. Billing questions and refund requests are handled by Apple under its policies.
7. Availability, updates, and changes to the App
We may update, modify, suspend, limit, or discontinue any part of the App or Site, including gameplay, leaderboards, advertising, purchases, compatibility, or support, at any time. We do not promise that the App will always be available, error-free, compatible with every device, or unchanged. Internet access and a compatible Apple device may be required for certain features.
8. Ownership and feedback
The App, Site, names, design, software, graphics, artwork, text, and other content are owned by us or used with permission and are protected by applicable intellectual-property laws. No ownership rights are transferred to you.
If you send ideas, suggestions, or feedback, you permit us to use them without restriction or payment, provided that this does not transfer ownership of any personal information you submit.
9. Disclaimers and limitation of liability
To the fullest extent permitted by applicable law, the App and Site are provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, merchantability, or non-infringement. Your use is at your own risk.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, rankings, purchases, profits, or goodwill; or interruption of service arising from use of or inability to use the App, Site, or external services. Nothing in these Terms excludes or limits rights or liability that cannot legally be excluded or limited.
10. Suspension and termination
You may stop using the App or Site at any time. Your rights under these Terms and Apple’s Standard EULA may terminate if you materially violate applicable terms or law. We may restrict access to features or support when reasonably necessary to protect the App, services, users, or legal rights.
11. Changes to these Terms
We may update these Terms when the App, Site, services, or legal requirements change. The revised version will be posted here with a new “last updated” date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
12. Governing terms
For use of the iOS App, Apple’s Standard EULA—including its applicable governing-law and third-party-beneficiary provisions—applies. For use of the Site and matters not governed by the Standard EULA, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where mandatory consumer-protection laws in your country or region require otherwise.
